California- San Diego Superior Court Ends Early Pandemic-Era Failed Zero Bail Policy

 


A policy that reduced certain misdemeanor offenses to zero bail throughout the San Diego County jail system, which was instituted to reduce the overall jail population during the COVID-19 pandemic, will be rescinded as of Sunday, the San Diego County Sheriff's Department said Friday.

The emergency bail modification enacted in early 2020 allowed those arrested for certain minor crimes such as drug possession or petty theft to avoid custody, while those already in jail for those offenses and with no other pending cases were released on their own recognizance.

According to a sheriff's department statement, a "significant decrease" in the county jail system's COVID-19 cases played a large role in a San Diego Superior Court order rescinding the zero-bail policy. Starting Sunday, those charges that qualified for zero bail will have set bail amounts imposed again. Those amounts will be based on those outlined in the San Diego Superior Court Bail Schedule.

The sheriff's department said the change "is likely to increase population numbers in the San Diego County jails."

While the zero-bail policy will be rescinded, a recent California Supreme Court ruling which holds that courts must consider an individual's ability or inability to pay when considering bail remains in place. The Humphrey decision holds that judges must mainly weigh a pre-trial detainee's dangerousness and risk of flight when ruling whether they should remain in custody.

In SB 6 and SB 9, the Texas Legislature made major changes to article 17.03 of the Texas Code of Criminal Procedure.  On this episode of the Bail Post we begin a new series placing a spotlight on changes to the Criminal Justice System of Texas that are set out in SB 9, SB 6 and several other statutes passed by the Texas Legislature. Episode No. 78- ODonnell v. Harris County- The Case That Will Not Die- Is The End Finally Coming?

On October 5, 2026, the Honorable Judge Lee Rosenthal issued an memorandum opinion in the ODonnell case.  The court was ruling on a motion to dismiss the consent decree that was filed by 4 of the 16 misdemeanor judges.   By way of history, the judges had been arguing for sometime that the consent decree did not comply with SB 6 and more recently did not comply with SB 9 passed by the Texas Legislature in the most recent Texas Legislative Session.  Additionally, since the consent decree/settlement agreement was entered, all of the substantive rulings made by the trial court in ODonnell had been reversed by the 5th Circuit.  Further, in the Daves II en banc opinion issued by the 5th Circuit, the court of appeals specifically stated that both Daves and ODonnell should never have been adjudicated in federal court.
