The Bail Post Episode No. 38- Florida's "Gnarly" Good Bail Reform Session with Guest Shawn Foster

Image
On May 1, 2023, Florida's Governor Ron DeSantis signed HB 1627.  The bill was described as Florida's response to disastrous “bad bail reforms” being pushed by liberal politicians and prosecutors in high-crime jurisdictions throughout the country. In this episode of the Bail Post we discuss HB 1627 and other bail bills passed in the most recent Florida Legislative Session.  Several highlights of the legislations is that the bill: Requires the Florida Supreme Court to develop a uniform statewide bond schedule by the end of the year; and Prohibits the chief judge of a judicial circuit from setting a lower bond amount for a criminal offense than the uniform statewide bond schedule.  “In Florida, we stand for the rule of law, we back our blue, and we treat offenders as they should be treated — not as victims, but as criminals who deserve to be behind bars,” said Attorney General Ashley Moody.“ That’s one of the reasons why we are the fastest growing state in the nation. Pensacola Man Abandons Child, Dog at Walmart After Fleeing Bail Bondsman

Image
A Pensacola man was arrested Wednesday after allegedly abandoning his child inside Walmart and leaving his dog inside a vehicle that was turned off, according to an arrest report. A bail bondsman was attempting to take 27-year-old Deangelo Meriweather into custody for a warrant when he ran outside of Walmart, leaving his child and dog on the property, according to an arrest report. The child was brought back to his residence by deputies and the Florida Department of Children and Families was notified, according to an arrest report. Animal control was also contacted to take custody of the dog. Deputies eventually located Meriweather and took him into custody. He is charged with neglecting a child without great bodily harm, abandoning an animal, and two counts of failing to appear for a felony offense. Meriweather was booked into Escambia County Jail Wednesday morning. He is held on no bond. To see more CLICK HERE .

Florida- Judge Dismisses ACLU 11 Lawsuits Attacking Private Surety Bail Against Manatee, Sarasota Counties

Image
The Second District Court of Appeals has denied 11 lawsuits filed by American Civil Liberties Union of Florida challenging the cash bail system in Manatee and Sarasota counties.  In November, the ACLU filed the 11 petitions on behalf of 11 people being held in Manatee and Sarasota county jails on cash bonds they cannot afford. Failing to give each of them an alternative to a cash bond was tantamount to holding them in pre-trial detention in violation of their rights under the Fourteenth Amendment of the U.S. Constitution, the 51-page petition claimed.  Between late December and early January, the appellate court denied all 11 petitions filed by the ACLU and 12th Judicial Circuit Public Defender’s Office. “Sheriffs have no authority over bail amounts or procedures. Bail amount is determined by a judge,” a statement from the sheriff’s office said. The ACLU of Florida is considering whether to pursue the cases in federal courts. “I think we are at the end of the road in th...

Florida Senate Bill 1534- Giving the Green Light to Career Criminals and Organized Crime

Image
RINOs and other Democrats tend to think they are helping people when they are actually putting people in harm’s way. Such is the case of Republican State Senator Jim Boyd and FL Senate Bill 1534. The bill makes shoplifting food “for the purpose of consumption” not a crime at all. (Lee Williams at Substack). FL Senate Bill 1534reads in part: A person’s theft of one or more food items with the intent to consume such items for the sustenance of himself or herself or another person under his or her care is not a theft violation for purposes of this paragraph. Wrong message In the real world, some states simply have a threshold between felony and misdemeanor, and the police or courts decide to prosecute based on individual situations. But codifying shoplifting as a sort of “right to steal,” instead of allowing that leeway to determine a prosecution, sends the wrong message to shoplifters. Stealing a sandwich is one thing- but the law states one OR MORE food items. They can do whatever...
